TERMS OF SERVICE

These Terms & Conditions ("Terms") govern your use of this website and the purchase of any products or services from Utopia Plates Ltd ("Utopia Plates", "we", "us", "our").

By accessing this website or placing an order you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the website or place an order.

These Terms do not affect your statutory rights as a consumer, including those under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

1. Definitions

In these Terms, the following words have the following meanings:

  • "Assignment" means the DVLA process by which a registration number is transferred onto, or removed from, a vehicle.
  • "BS AU 145e" means the British Standard for retroreflecting number plates in force in the United Kingdom, as may be amended or superseded from time to time.
  • "Certificate" means a V750 Certificate of Entitlement or a V778 Retention Document issued by the DVLA.
  • "Done-For-You Transfer Service" means the optional paid service described in section 12 under which we handle the DVLA assignment on your behalf.
  • "DVLA" means the Driver and Vehicle Licensing Agency.
  • "Nominee" means the person named on a Certificate as entitled to assign the registration to a vehicle.
  • "Number Plates" means the physical acrylic vehicle registration plates manufactured by us.
  • "Order" means your order for a Registration, Number Plates, or any associated service.
  • "Registration" means a vehicle registration number offered for sale through our website, whether sourced directly from the DVLA or from a third-party seller.
  • "RNPS" means a Registered Number Plate Supplier, regulated by the DVLA under the Vehicles (Crime) Act 2001.
  • "V5C" means the Vehicle Registration Certificate (logbook) issued by the DVLA.

3. Eligibility

By placing an Order you confirm that:

  • you are at least 17 years old;
  • you are legally capable of entering into a binding contract;
  • the information you provide is accurate and complete; and
  • you are purchasing as a consumer (unless you have identified yourself to us as a business customer at the point of order).

We sell to customers across the United Kingdom, including England, Scotland, Wales and Northern Ireland. We do not currently accept orders for delivery to addresses outside the United Kingdom.

4. Registered Number Plate Supplier Compliance

Utopia Plates Ltd is a Registered Number Plate Supplier (RNPS) and manufactures number plates in accordance with British Standard BS AU 145e, the Road Vehicles (Display of Registration Marks) Regulations 2001, and the Vehicles (Crime) Act 2001.

UK law requires us to verify documentation before manufacturing number plates. Customers must provide valid:

  • proof of identity; and
  • proof of entitlement to the registration number.

Acceptable examples include:

  • V5C Logbook;
  • V750 Certificate of Entitlement;
  • V778 Retention Document.

We reserve the right to refuse production if valid documentation cannot be supplied, and to cancel any Order where appropriate documentation cannot be verified.

Every plate manufactured by us carries the RNPS supplier marking required by law.

5. Document Submission Timeframe

Customers ordering number plates must provide valid proof of identity and entitlement documentation within a reasonable timeframe.

If the required documentation has not been provided within 90 days of the Order date, Utopia Plates Ltd reserves the right to cancel the Order.

Where an Order is cancelled due to documentation not being supplied:

  • the Order may be treated as abandoned;
  • a reasonable administration fee may be retained to cover processing and payment costs; and
  • the remaining balance may be refunded at our discretion.

If documentation is not provided within 12 months, the Order may be considered permanently abandoned and cancelled. Customers wishing to proceed after this time may need to place a new Order and pay the then-current price.

6. Road Legal Number Plates

Utopia Plates Ltd produces fully road-legal number plates only, manufactured in accordance with British Standard BS AU 145e and the Road Vehicles (Display of Registration Marks) Regulations 2001.

We will not manufacture number plates that:

  • contain illegal spacing;
  • use non-compliant fonts;
  • use reflective backgrounds, colours or materials not permitted under UK law; or
  • otherwise breach UK regulations.

Our website may automatically correct registration spacing during the ordering process. If a customer manages to submit a registration with illegal spacing, we will correct the spacing to the legally compliant format before manufacturing.

7. Alteration of Number Plates

All number plates leave our manufacturing facility in a fully road-legal configuration.

Customers must not:

  • remove characters;
  • reposition characters;
  • apply overlays, tints, films or finishes; or
  • otherwise modify plates after production.

If number plates are altered after leaving our premises, Utopia Plates Ltd accepts no liability for any resulting fines, MOT failures, penalties or legal consequences.

We may retain manufacturing records or images showing the plates in their original compliant configuration and may use these to evidence compliance in the event of a dispute.

8. Number Plate Orders

Number plates are custom-manufactured products, personalised to the customer's registration.

As personalised goods, number plates are exempt from the 14-day cooling-off period under regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Your statutory rights in relation to faulty or mis-described goods under the Consumer Rights Act 2015 are unaffected.

Once manufacturing has begun, Orders cannot be cancelled. Plates produced correctly and to the specification ordered are not eligible for return or refund.

If a cancellation is requested before manufacturing begins, we reserve the right to charge a £5 cancellation fee per plate to cover processing and payment costs.

We guarantee that number plates supplied by us will, at the time of delivery, be manufactured in accordance with BS AU 145e and free from manufacturing defects. If a plate is found to be defective within 36 months of delivery, and the defect is not the result of alteration, accident or misuse, we will replace the plate free of charge on return of the original.

9. Use of Number Plates

Customers must only display number plates on a vehicle after the registration has been correctly assigned to that vehicle through the DVLA.

Number plates must only be fitted to the specific vehicle to which the registration has been legally assigned.

Customers must not:

  • display number plates before DVLA assignment is completed;
  • display number plates on a vehicle other than the one assigned;
  • drive a vehicle displaying plates that are not legally registered to it.

Utopia Plates Ltd accepts no liability for fines, penalties, enforcement action or legal consequences arising from the use of number plates before proper DVLA assignment or on an incorrect vehicle.

Customers are responsible for ensuring that registration assignments have been successfully completed before fitting or using number plates.

10. Private Registration Purchases

Utopia Plates offers:

  • Registrations sourced directly from the DVLA; and
  • pre-owned Registrations sourced from third parties.

10.1 DVLA Registrations

When a customer purchases a DVLA Registration, we typically purchase the Registration from the DVLA shortly after the Order is placed. Once this purchase has been completed, cancellation may not always be possible.

Customers may request cancellation within 10 days of the Order date; however, cancellation cannot be guaranteed once the Registration has been issued by the DVLA in the customer's name or on their behalf.

If cancellation is approved, a reasonable administration fee (including non-refundable payment processing costs and any irrecoverable DVLA fees) will be retained. Customers may alternatively change their purchase to another Registration and pay or receive the price difference.

Certificates issued by the DVLA (V750/V778) have a 10-year validity. It is the customer's responsibility to assign the Registration, or apply to renew the Certificate, before it expires. Utopia Plates accepts no liability for Certificates that lapse in the customer's possession.

10.2 Pre-Owned Registrations (Featured Registrations)

Pre-owned Registrations — marketed on our website as "Featured Registrations" — are sourced from third-party sellers. While we make every effort to secure these Registrations, successful acquisition cannot be guaranteed.

Situations may arise where:

  • the Registration has already been sold;
  • the seller is uncontactable;
  • the seller withdraws the Registration from sale; or
  • the DVLA declines to complete the transfer.

If we are unable to obtain the Registration, the customer will receive a full refund of all sums paid in respect of that Registration, normally processed within 14 days of cancellation.

Utopia Plates Ltd acts in its own commercial interest when negotiating the purchase of pre-owned Registrations. Prices displayed include our margin.

Transfer options for pre-owned Registrations

Because a pre-owned Registration comes to us from a third-party seller, and to protect that seller's privacy, the Registration cannot be transferred directly from their Certificate to a new Certificate held in your name. Once we have secured the Registration on your behalf, you may choose one of the following two transfer routes:

  1. Direct assignment to your vehicle — no additional charge. We will assign the Registration directly to a vehicle you nominate free of charge, using our Done-For-You Transfer Service (section 12). This is the quickest route and no additional transfer fee applies.
  2. Placement on a new Retention Certificate — £80. If you would prefer to hold the Registration on a V778 Retention Document in your name rather than fit it to a vehicle immediately, we will (i) first assign the Registration to a nominated vehicle and then (ii) remove it from that vehicle onto a new Retention Certificate issued in your name. An £80 fee applies to this process to cover the DVLA retention application and our associated administration.

In both cases, the customer must provide the documentation set out in section 4 (and, for option 1 under the Done-For-You Transfer Service, the documentation set out in section 12). DVLA rules on vehicle age and eligibility (section 11) apply.

The £80 fee under option 2 is non-refundable once the process has been initiated, save where we are unable to complete the retention for reasons within our control.11. Assignment of Registrations

Customers are responsible for assigning Registrations to their vehicles unless they purchase the Done-For-You Transfer Service (section 12).

Customers must ensure that:

  • the Registration is valid for their vehicle age (a Registration may not be used to make a vehicle appear newer than it is);
  • the vehicle type is eligible for a private Registration; and
  • the vehicle meets DVLA requirements (current MOT, current vehicle tax, correct documentation).

Certain vehicles (including Q-plated vehicles, some agricultural vehicles and certain imports) may not be eligible for private Registrations under DVLA rules.

Utopia Plates Ltd accepts no responsibility if a Registration cannot be assigned due to vehicle eligibility restrictions, DVLA rules or customer-provided information that proves incorrect. We do not provide legal advice regarding Registration eligibility, and customers are responsible for verifying compatibility with DVLA rules prior to purchase.

12. Done-For-You Transfer Service

Customers who purchase the Done-For-You Transfer Service authorise Utopia Plates Ltd to assist in assigning the Registration through the DVLA on their behalf.

Customers must provide:

  • a clear image of the V5C logbook;
  • accurate vehicle and keeper information; and
  • any additional information reasonably requested to complete the transfer.

Transfers may fail if the vehicle does not meet DVLA requirements, including:

  • no valid MOT;
  • no vehicle tax;
  • incorrect or mismatched documentation; or
  • DVLA-applied markers on the vehicle record.

In these situations the customer must resolve the issue before we can complete the transfer. The Done-For-You Transfer Service fee is non-refundable once the transfer process has been initiated, save where set out in section 13.

DVLA processing times are outside our control. We will normally complete transfers within the DVLA's published service levels.

12.1 Postal Transfer Process

In some circumstances the DVLA system may block an online transfer due to markers placed on a vehicle record. When this occurs, the transfer must be completed using a manual postal process.

If required:

  • we will provide a pre-paid Royal Mail shipping label;
  • the customer must send their V5C logbook to us; and
  • we will submit the V5C and V750 Certificate of Entitlement to the DVLA on the customer's behalf.

This process is determined solely by DVLA systems and is outside our control. Utopia Plates Ltd accepts no liability for delays caused by DVLA manual processing.

13. Transfer Timeframe and Refund Guarantee

Where you have (a) purchased a Registration through us, (b) paid in cleared funds, and (c) provided all required documentation in the form requested, we will use reasonable endeavours to complete the Assignment or deliver the Certificate within 12 weeks.

If, after 12 weeks from the later of cleared payment and receipt of complete, correct documentation, we have not completed the Assignment (or delivered the Certificate to you) for reasons other than DVLA delay outside our control, a defect in the documentation you have supplied, or a vehicle eligibility issue, you are entitled on written request to a full refund of all sums paid in respect of that Registration.

This clause does not affect your other rights under these Terms or under UK consumer protection law.

14. Certificate of Legality

Number plates may be supplied with a Certificate of Legality. This certificate confirms that the plates were manufactured in compliance with UK regulations and BS AU 145e at the time of production.

The Certificate of Legality:

  • applies only to number plates produced by Utopia Plates Ltd; and
  • does not guarantee future compliance if the plates are altered, modified or used incorrectly.

15. Accidental Damage Coverage

Customers may purchase Accidental Damage Coverage as an optional add-on.

This provides 24 months of protection from the date of Order against:

  • theft;
  • loss; and
  • accidental damage.

Coverage allows up to two like-for-like replacement plates during the coverage period. Replacement plates must:

  • use the same Registration; and
  • use the same style and specification as the original Order.

No design or Registration changes are permitted under this coverage. Pricing of the coverage may change at any time and applies at the price in force at the date of Order.

Accidental Damage Coverage is provided by Utopia Plates Ltd and is not a contract of insurance.

16. Pricing, Errors and Price Changes

All prices are displayed in pounds sterling (£) and include VAT at the applicable rate where chargeable.

While we strive to ensure that all information on our website is accurate, errors may occasionally occur. We reserve the right to cancel Orders where:

  • a Registration is unavailable;
  • pricing errors occur;
  • a technical malfunction results in an incorrect price; or
  • a system error allows the purchase of unavailable Registrations.

Where an Order is cancelled under this section, customers will be offered either a full refund or an alternative product of equivalent value.

Prices on the website may change from time to time. The price payable for your Order is the price displayed at the time the Order is placed and accepted.

17. DVLA System Issues

We are not responsible for delays or failures caused by:

  • DVLA system outages;
  • DVLA service interruptions;
  • DVLA processing delays; or
  • changes to DVLA rules or fees between Order and Assignment.

Where DVLA systems prevent a transaction from completing, we will attempt to resolve the issue but cannot guarantee processing times.

Any DVLA fees (including Assignment and Retention fees) are passed through at cost. If the DVLA increases such fees between the date of Order and the date of Assignment, we reserve the right to pass the difference on to the customer, or, where this is not acceptable to the customer, to cancel the relevant Order and refund the amounts paid.

18. Fraud and Suspicious Orders

We reserve the right to cancel Orders and refuse service where we suspect:

  • fraudulent payments;
  • use of stolen payment instruments;
  • attempts to bypass legal requirements or DVLA rules;
  • use of false or misleading identity documents; or
  • abusive, threatening or unlawful behaviour toward staff.

Refunds will be issued where appropriate. Suspected fraud may be reported to the police, Action Fraud and relevant payment providers.

19. Chargebacks and Payment Disputes

Customers agree to contact Utopia Plates Ltd to resolve any issue before initiating a payment dispute or chargeback with their payment provider.

Submitting a chargeback after a product or service has been delivered, or after a Registration has been purchased on the customer's behalf, may be considered a fraudulent dispute.

Where a chargeback is initiated incorrectly, Utopia Plates Ltd reserves the right to provide evidence to the payment processor including (but not limited to):

  • order records;
  • manufacturing records;
  • Registration purchase confirmations;
  • delivery confirmations; and
  • customer communications.

Where a chargeback results in financial loss to Utopia Plates Ltd despite the goods or services having been legitimately supplied, we reserve the right to pursue recovery of those costs, together with any reasonable administrative and legal costs, through appropriate legal channels.

20. Shipping and Delivery

Delivery times quoted on the website or at checkout are estimates only.

We are not responsible for delays caused by:

  • courier services;
  • postal disruptions;
  • weather conditions; or
  • industrial action.

If a parcel is lost in transit, we will investigate with the courier and, where appropriate, issue a replacement or refund. In most cases replacements will be dispatched once the courier confirms the item as lost or after a reasonable investigation period.

Customers must ensure delivery information is accurate. We are not responsible for non-delivery caused by incorrect or incomplete delivery details supplied by the customer.

Risk in Number Plates passes to the customer on delivery.

21. Click and Collect

Orders may be collected from:

Customers may be required to provide proof of identity when collecting orders. Orders not collected within 60 days of notification that they are ready may be disposed of, and a re-order may be required.

22. Plate Cloning and Misuse

Utopia Plates Ltd manufactures number plates strictly in accordance with UK regulations and based on documentation provided by customers.

We are not responsible for:

  • misuse of number plates;
  • fraudulent use of Registrations; or
  • vehicle cloning activities carried out by third parties.

Customers are responsible for reporting suspected cloning or misuse to the police, the DVLA and any relevant authorities. We will cooperate fully with law-enforcement investigations where properly requested to do so.

23. Consumer Rights and Cancellation

Nothing in these Terms limits or excludes your statutory rights as a consumer. In particular:

  • your rights under the Consumer Rights Act 2015 that goods must be of satisfactory quality, fit for purpose, and as described; and
  • your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Please note that:

  • Number plates are personalised goods and are exempt from the 14-day cancellation right under regulation 28(1)(b) of the Consumer Contracts Regulations 2013 once manufacture has begun.
  • Services (including Registration purchases, the Done-For-You Transfer Service and Accidental Damage Coverage) begin as soon as we start performance, which we take to begin at the point of Order unless you tell us otherwise. By placing an Order you expressly request that performance begins immediately and acknowledge that you will lose the right to cancel once the service is fully performed.

If you believe goods or services supplied to you are defective or not as described, please contact us using the details in section 36 so that we can investigate and, where appropriate, repair, replace or refund.

24. Complaints Procedure

We aim to provide a high standard of service. If something has gone wrong, please tell us so we can put it right.

Complaints should be sent in writing to [email protected] or by post to our registered office (section 2), marked for the attention of Customer Services.

We will:

  • acknowledge your complaint within 2 working days;
  • investigate and provide a substantive response within 10 working days; and
  • if we need longer to investigate, keep you informed of progress and provide a final response within 8 weeks.

25. Alternative Dispute Resolution

If you are not satisfied with our final response to a complaint, you may refer the matter to an Alternative Dispute Resolution (ADR) provider. We are happy to engage with a recognised certified ADR body where both parties agree to participate.

In addition, consumers within the United Kingdom can access information on consumer rights and escalation routes via Citizens Advice (citizensadvice.org.uk / 0808 223 1133) and Trading Standards.

Nothing in this section prevents you from taking legal action.

26. Data Protection and Privacy

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Details of the personal data we collect, how we use it, the legal bases we rely on, how long we keep it, and your rights as a data subject (including the right of access, rectification, erasure, restriction, objection and portability) are set out in our Privacy Policy, which forms part of these Terms by reference.

We share documentation with the DVLA as necessary to fulfil Orders, and with couriers, payment processors and anti-fraud services in accordance with the Privacy Policy.

27. Intellectual Property

All content on this website — including text, graphics, logos, images, product photography, website layout, software and the "Utopia Plates" name and branding — is the property of Utopia Plates Ltd or its licensors and is protected by UK and international intellectual property laws.

You may view, download and print content from the website for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, distribute, frame or exploit any content without our prior written consent.

No licence is granted to use any Utopia Plates trademark or trade name.

28. Website Use

You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the website by any third party.

You must not:

  • introduce viruses, trojans or other malicious material;
  • attempt to gain unauthorised access to the website or any server, computer or database connected to it; or
  • attack the website via a denial-of-service attack.

We may suspend or terminate your access to the website at any time for breach of these Terms.

29. Force Majeure

Utopia Plates Ltd shall not be liable for any failure to perform, or delay in performing, its obligations under these Terms where such failure or delay is caused by events outside our reasonable control, including (without limitation):

  • acts of God, severe weather, flood, fire or earthquake;
  • epidemic or pandemic;
  • war, riot, civil unrest, acts of terrorism or cyber-attack;
  • industrial action or transport disruption;
  • failures of utilities, communications networks or couriers;
  • DVLA system outages, service interruptions or policy changes; and
  • acts or failures of government or regulatory authorities.

Where such an event occurs we will notify affected customers as soon as reasonably practicable and use reasonable efforts to minimise delay. If the event continues for more than 60 days, either party may cancel the affected Order and we will refund any sums paid for goods or services not supplied.

30. Limitation of Liability

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • breach of the implied terms as to title and quiet possession under section 17 of the Consumer Rights Act 2015; or
  • any other liability that cannot be limited or excluded under UK law.

Subject to the above, and to the fullest extent permitted by law, Utopia Plates Ltd shall not be liable for:

  • penalties resulting from modified number plates;
  • incorrect Registration Assignment by customers;
  • vehicle eligibility restrictions;
  • DVLA processing delays;
  • courier delays or disruptions;
  • loss of profit, loss of business, loss of reputation or any indirect or consequential loss; or
  • any loss or damage arising from your failure to comply with DVLA rules or UK road traffic law.

Our total liability to you in connection with any Order shall not exceed the total price paid by you for that Order, save where a higher amount is required by law.

31. Call Recording

Telephone calls to and from Utopia Plates Ltd may be recorded for training, quality-assurance, dispute-resolution and fraud-prevention purposes. By calling us you consent to this recording. Recordings are retained for a reasonable period and processed in accordance with our Privacy Policy.

32. Third Party Rights

A person who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.

33. Severability, Waiver and Whole Agreement

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, unlawful or unenforceable, the remaining provisions shall continue in full force and effect.

No failure or delay by us in exercising any right under these Terms shall operate as a waiver of that right. A waiver given in any instance does not waive any subsequent right.

These Terms, together with the Privacy Policy and any document expressly incorporated by reference, constitute the entire agreement between you and Utopia Plates Ltd in relation to the subject matter of your Order and supersede any prior arrangements or understandings.

We may assign or subcontract any of our rights or obligations under these Terms. You may not assign your rights or obligations without our prior written consent.

34. Changes to Terms

We reserve the right to update these Terms at any time. The version in force at the date of your Order will apply to that Order.

Changes will take effect once published on our website. We will identify the date of the most recent update at the top of these Terms. Material changes will, where reasonably practicable, be notified to existing customers.

35. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims), are governed by and shall be construed in accordance with the laws of England and Wales.

You and Utopia Plates Ltd agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any such dispute or claim, save that nothing in this section shall prevent a consumer resident in Scotland or Northern Ireland from bringing proceedings in their local courts.
